Docthub Health Tech Private Limited (“Docthub”) is the author and publisher of the internet resource https://jobs.docthub.com (“Jobs Portal”). Docthub owns and operates the Docthub Jobs services provided through the web and mobile applications, through Docthub Healthcare Career App on Android and iOS. It operates “Recruiter” software module through https://enterprise.docthub.com (“Website” or “Service”) which allows organizations to post job vacancies on Jobs Portal and search, view, and download job seekers candidate profiles for further healthcare recruitment purpose. These Terms and Conditions govern the use of the Website, content and community services offered through https://jobs.docthub.com and https://enterprise.docthub.com any mobile or internet connected device or otherwise. This terms and conditions policy are applicable to all enterprise users who are using ‘Recruiter’ software application module through Docthub Enterprise application (https://enterprise.docthub.com).

To register, you can go to www.docthub.com, click on ‘For Organizations’, and then click on ‘Create an Enterprise Account’ it will redirect you on https://enterprise.docthub.com/register, submit the form and verify through your Business Email or Work Email address.

Docthub reserves the right to suspend / cancel, or discontinue any or all channels, products or services at any time without notice to you, make modifications and alterations in any or all of the content, products and services contained on the Website without prior notice. Such changes will be posted to https://jobs.docthub.com/recruiter-policy for your reference and convenience so as to enable you to understand your responsibility as a user.

In particular, Docthub may suspend, cancel, terminate or modify our referral offers or discount offers through promo codes, including any terms and conditions and any referral functionalities at any time in our sole discretion. Referral links or discount coupon codes may not function following any discontinuance of, or changes to, the associated referral offer(s). By participating in our referral program or discount coupon promo code, you acknowledge and agree that it is your responsibility to review and understand the offers active at any particular time, and that you will be bound by such changes as may be made from time to time. If you do not accept any such changes, your sole and exclusive remedy is to cease participation in this program.

Docthub reserves the right to charge subscription and/ or membership fees from a user, by giving reasonable prior notice, in respect of any product, service or any other aspect of the Docthub Enterprise application (https://enterprise.docthub.com). Docthub may suspend, cancel, terminate or modify any rewards or referral offers or discount promo code, including any terms and conditions and any rewards or referral functionalities at any time in our sole discretion. Offer or referral links or promo codes may not function following any discontinuance of, or changes to, the associated referral offer(s). By participating in our rewards and referral programs, you acknowledge and agree that it is your responsibility to review and understand the offers active at any particular time, and that you will be bound by such changes as may be made from time to time. If you do not accept any such changes, your sole and exclusive remedy is to cease participation in this program.

Unless otherwise stated, copyright and all intellectual property rights in all material presented on the Website (including but not limited to text, audio, video or graphical images), trademarks and logos appearing on the Website and the Service are the property of Docthub Health Tech Private Limited, its parent, affiliates and associates and are protected under applicable Indian, European Union, United States and other laws. You agree not to use any framing techniques to enclose any trademark or logo or other proprietary information of Docthub; or remove, conceal or obliterate any copyright or other proprietary notice or any credit-line or date-line on other mark or source identifier included on the Website/ Service, including without limitation, the size, color, location or style of all proprietary marks. Any infringement shall be vigorously defended and pursued to the fullest extent permitted by law.

In these Terms, “Enterprise User”, “you” and “your” refer to (a) you, the individual accessing the Website, (b) you, independent contractor or practitioner or doctor, and (c) the business entity on whose behalf an individual or electronic agent is accessing the Website and the Jobs Portal, You represent and agree that all information that you provide to Docthub in connection with your access to and use of the Website is and shall be true, accurate, and complete, to the best of your knowledge, ability, and belief. We reserve the right to terminate these Terms, or to refuse, restrict, or discontinue service or access to the Website or the Jobs Portal (or any portions, components, or features thereof) to you or any other person or entity, for any reason or for no reason whatsoever, at any time, without notice or liability. Failure to comply with these Terms may, among other things, result in the immediate termination of your access to and use of the Website and the Service. We reserve the right to verify your identity as a condition of your use of our Website and Jobs Portal. We may collect and disclose to our business partners and their regulators certain personal information as set forth in our Privacy Policy, including without limitation in connection with applicable law and our business partners’ know-your-customer (“KYC”) and other such policies and procedures.

Docthub grants you a personal, non-exclusive, non-transferable, limited license to use the Website or Service and to view or access the Website and the Service solely for your personal or internal use and subject to the condition that you do not (and do not allow any third party to) copy, modify, create a derivative work from, reverse engineer (except to the extent permitted by applicable law), reverse assemble, or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in, or otherwise transfer any right in or access to the Website, the Jobs Portal, or any other Content available via the Website and the Jobs Portal. You further agree neither to modify the Website, or any part thereof, in any form or manner, nor to use any modified versions of the Website or the Service, for any reason whatsoever, without the express written consent of Docthub. You may not attempt to gain any unauthorized access to the Website and the Service or any of its associated Content, including computer systems, software, or networks. No redistribution of any Content, materials, or information contained on or offered through the Website or the Services is permitted, unless expressly specified in a prior agreement between you and Docthub.

We are not responsible for the content, accuracy, or reliability of any third-party materials or services made available through our Website or Jobs Portal.

Docthub Enterprise application has a software module ‘Recruiter’ through which Enterprise Account users can utilize for healthcare recruitment activity for their organizations and get benefits from Docthub Jobs Portal and its job seekers or candidate profile database. The Recruiter service has multiple functionalities, but not limited to (1) Job Posting, (2) Internship Posting, (3) Campus Recruitment, (4) Recruiter Page, (5) Candidate Search, (6) Interview Tracker, (7) Walk-In Interview Post.

For posting job vacancy on Docthub Jobs platform, any healthcare organization can access Docthub Enterprise application on https://enterprise.docthub.com and create enterprise account and explore Recruiter module to post a job vacancy. Explore more information on https://jobs.docthub.com/recruiter. From recruiter module, enterprises can post job vacancy, internship post, locum duty and candidate search for direct connecting with job seekers and healthcare professionals in different filters of stream, education, specialty, job category, key skills, and location.

With ‘Candidate Search’ feature, an enterprise user can search candidate profiles and download their resume or save their profile for interview or future reference, it only allows to search job seekers and/or users’ profiles who have created Docthub account, shared profile details, actively searching jobs, applied or saved jobs details, set job preferences, or profiles shared by Docthub affiliates and partners in Docthub Jobs Portal within the Docthub Platform Privacy Policy. Enterprise Users need to purchase Candidate Credits through Recruiter Subscription service to access candidate profiles, such credits will be utilized while unlocking the profile, download resume as per defined rules of Candidate Credit Utilization which is displayed on top right corner in the Candidate Search feature of ‘Recruiter’ module.

With ‘Recruiter Page’ feature, enterprise user can publish and manage content of their Company or Organization’s web page on Jobs Portal which creates their digital branding around healthcare recruitment, organizational culture, showcase achievements, publish notices, communicate with healthcare professionals by chat or exchanging messages or connecting via call and email. It allows Job Seekers or professionals or individual users to connect and view contact details of Enterprise User through ‘Recruiter Page’ or ‘Recruiter Connect’ feature on Jobs Portal.

Any use or attempted use of the Website: (i) for any unauthorized, fraudulent or malicious purpose; (ii) that could damage, disable, overburden, or impair any server, or the network(s) connected to any server; (iii) that could interfere with any other party's use and enjoyment of the App or Website(s); (iv) to gain unauthorized access to any other accounts, computer systems or networks connected to any server or systems through hacking, password mining or any other means; (v) to access systems, data or information not intended by Docthub to be made accessible to a user; (vi) to attempt to obtain any materials or information through any means not intentionally made available by us; or (vii) for any use other than the purpose for which it was intended, is prohibited.

In addition, in connection with your use of the Website, you agree you will NOT:

Docthub reserves the right to monitor the use of the Website and the Jobs Portal and to take whatever lawful actions it may deem appropriate in response to actual or suspected violations of the foregoing, including, without limitation, withholding cash back or the suspension or termination of a user’s access and/or account. Docthub may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong. Except as may be expressly limited by the Privacy Policy, Docthub reserves the right at all times to disclose any information as Docthub deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Docthub’s sole discretion. You also agree to reimburse Docthub for any damage, loss, cost or expense Docthub incurs (including fees or costs of attorneys, accountants, professional advisors, and other experts incurred in connection with the defence or settlement of the foregoing) because of your use of the Website or the Jobs Portal for any unlawful or prohibited purpose. Docthub reserves the right to remove any user-submitted content that may be infringing on another person’s intellectual property rights with or without notice to the infringer and in accordance with applicable intellectual property or other laws, including The Patents Act, 1970, The Trade Marks Act, 1999, and The Copyright Act, 1957 of Government of India and Digital Millennium Copyright Act (“DMCA”) of United States, and Information Technology Act, 2000 and Digital Privacy Data Protection (DPDP) Act, 2023 of India.

Any information, images, communications, or material of any type or nature that you submit to the Website and the Jobs Portal, or any of our pages contained on a social media platform or website by e-mail, chats, posting, messaging, uploading, downloading, or otherwise (collectively, a “Submission”) is done at your own risk and without any expectation of privacy.

As part of the Services, Company may provide enterprise subscription services to its Enterprise Users including but not limited to Docthub access to behind the paywall content. When you subscribe to Docthub Enterprise subscription as part of Services offered by Company on the Website or the Service, you gain access to list your event, manage event through Event Organizer module features, and other enterprise module or features specially chosen for you by the Docthub team. The nature of content and module features behind the paywall is subject to change at the sole discretion of Company; the decision of Company and/or its representatives in this regard shall be final and binding on Enterprise Users.

Enterprise Subscription-based Services may differ from country to country and the device from which you subscribe. Enterprise Subscription packages and price may also vary in time. The subscription prices shall be determined by the Company, in its sole discretion.

When you purchase a subscription, you must provide us with complete and accurate payment and other information required by the Company. By submitting payment details, you represent, warrant and undertake that you are entitled to purchase a subscription using those payment details. If we do not receive payment authorization or any authorization is subsequently cancelled, we may immediately terminate or suspend your access to your subscription-based Services or your entire access to Services on the Website. In suspicious circumstances, we may contact the issuing bank/ payment provider and/or law enforcement authorities or other appropriate third parties. If you are entitled to a refund under these terms and conditions, we will credit that refund to the card or other payment method you used to submit payment, unless it has expired in which case we will contact you. Company uses third party payment gateway services for receiving payment from Users for its subscription-based Services and you hereby agree to your details and information being shared with such third-party payment service providers.

For our enterprise subscription-based services, Company shall endeavour to process your subscription promptly, but Company does not guarantee that your enterprise subscription will be activated by any specified time. By submitting your payment and other subscription details, you are making an offer to us to buy a subscription. Your offer will only be accepted by us and a contract formed when we have successfully verified your payment details and email address, at which point we will provide you with access to your subscription. Company reserves the unfettered right to reject any offer made by its Enterprise Users, at its discretion, for any or no reason.

The enterprise subscription price for our subscription-based services will be made clear to you on our Event Organizer Solution web page or the Docthub Enterprise application in ‘Subscriptions’ section and location of such details on our Website may vary from time to time, by region or by country. In order to obtain our subscription-based Services, you hereby agree to pay the fees at the rates notified to you at the time you purchase your subscription and at such frequencies as notified from time to time. For certain subscription-based Services offered by Company, including, but not limited to, Docthub, the Company however may choose to offer fixed term, or fixed payment frequency offers from time to time to Users. The currency in which your subscription is payable will be specified during the order process, depending on the Service and your country of business KYC address. Eligibility for any discounts is ascertained at the time your subscription and cannot be changed during the term and subsistence of your subscription. We publish our pricing on our Website(s) and the Service pages to you in advance of any increase in the price of your subscription and offer you an opportunity to cancel it if you do not wish to pay the revised price.

Subscription and access to subscription-based Services fall under the purview of applicable Tax laws of India. Taxes are applicable for consumption of content and services on the Website and other Services of Company for Enterprise Users based in India, and outside the country. Unless otherwise indicated, prices stated on the Website are inclusive of applicable taxes, including, but not limited to, Goods and Services Tax (GST) or other applicable taxes.

You hereby agree and acknowledge that the content and services on the Website may become subject to technical glitch and/or errors including but not limited to price list, subscription details etc. If we incorrectly or due to a technical glitch or error state a price to you whether online or otherwise, we are not obliged to provide you with a subscription at that price, even if we have mistakenly accepted your offer to buy a subscription at that price, and we reserve the right to subsequently notify you of any pricing error. If we do this, you may cancel the subscription-based Service without any obligation to us and we will refund you any money you have paid us in full, or you may pay the correct price. If you refuse to exercise either of these choices, then we may cancel your access to our subscription-based services and will refund to you any money you have paid us in full. Company always endeavours to act in good faith in determining whether a genuine pricing error has occurred or not.

In addition to any subscription fees, you pay for our enterprise subscription-based Services, you are responsible for paying any internet connection or other telecommunications charges or any other costs or charges that you may incur by accessing the Service and/or subscription-based Services. For example, if you use any of our mobile app services, then your network operator may charge you for data or messaging services.

You can choose an enterprise subscription-based Service for the term and duration offered by the Company as listed on the Website and the Service.

Enterprise Users accessing the Website or the Service through Web/ Mobile app will be given an option to opt for autorenewal as per the norms defined by the Reserve Bank of India (RBI). If you have opted for autorenewal in Web or Mobile app (including Android and iOS) or if you access, then your subscription will renew automatically unless you cancel it before it renews in order to avoid billing of subscription fees for the renewal term. We will notify you through email prior to the renewal date.

In case of Enterprise Users opted for free trial on the Website and the Service through Web/ Mobile app (including Android and iOS) app, subscription commences immediately once free trial duration for a particular plan opted by a User, if any provided at Company’s discretion, is over and on the realization of payment of the subscription fees from the Users. You hereby acknowledge and agree that the free trial will auto convert to paid post free trial duration ends. However, for Users accessing the Website and the Service through Web/ Mobile app (including Android and iOS) app, free trial will not automatically convert to paid and Enterprise Users shall be required to accept the ‘Terms and Conditions’ and provide payment details to access the free trial services.

Subscription to the enterprise subscription-based Services commences immediately on the realization of payment of the subscription fees from the Enterprise Users and there can be no cancellation once an Enterprise User’s account is activated for the subscription-based services for the term of that subscription period.

If you choose to pay annually and have opted for auto renewal in Web/ Mobile app (including Android and iOS) app, at least 15 days before each renewal you will be sent a reminder notice stating the rate that will apply for the renewal period. Unless you notify us before the end of your annual subscription period that you no longer wish to receive it, your annual subscription will renew for another year. We will charge the enterprise subscription using the same card or other payment method that you previously used.

You do not have any right to cancel your enterprise subscription or any part of it until the end of your then- current subscription period. Although you may notify us of your intention to cancel at any time, such notice will only take effect at the end of your then current enterprise subscription period. You may notify us of your wish to cancel your subscription by clicking on “Cancel Subscription” button from your enterprise account.

The Company reserves the right to suspend or terminate your enterprise subscription if you breach these Terms, with or without notice and without further obligation to you including any obligation to refund. We may also suspend or terminate your subscription if we are prevented from providing Services to you by circumstances beyond our control. The Company may, in exceptional circumstances, cease to publish the Website and the Service, the Website content or cease to provide subscription-based services. The Company will give you at least 15 days' notice of this, if possible but it is not guaranteed. If we do so, then we will have no further obligation to you except for a refund of the unexpired period of your paid subscription. This means that we will refund you with any amounts that you have paid us in advance that relate to any remaining and unexpired period of your subscription.

If you are a registered Enterprise User but have not subscribed for our subscription-based Services, then the Company reserves the right to suspend or terminate your registration at any time, with or without notice and without further obligation to you. If you would like to cancel your registration, then you can go to Account Settings, and click on “Delete Enterprise Account”, from Account Settings.

We shall not be liable for any delay or failure to perform due to events beyond its reasonable control, including acts of God, natural disasters, pandemics, strikes, supply chain delays, or governmental actions.

As a condition of your use of the Service, you will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Services in any manner that could damage, disable, overburden, or impair any Docthub's server, or the network(s) connected to any Docthub server, or interfere with any other party's use and enjoyment of any Services. You may not attempt to gain unauthorized access to any Services, other accounts, computer systems or to any of the Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services.

All information, data, text, software, music, sound, photographs, graphics, video, messages or other materials (collectively, ”Content”), whether publicly or privately transmitted/ posted, is the sole responsibility of the person from where such content is originated (the “Originator”). By posting any material which contain images, photographs, pictures or that are otherwise graphical in whole or in part ("Images"), you warrant and represent that (a) you are the copyright owner of such Images, or that the copyright owner of such Images has granted you permission to use such Images or any content and/or images contained in such Images consistent with the manner and purpose of your use and as otherwise permitted by these Terms and the Services, (b) you have the rights necessary to grant the licenses and sublicenses described in these Terms, and (c) that each person depicted in such Images, if any, has provided consent to the use of the Images as set forth in these Terms, including, by way of limitation, the distribution, public display and reproduction of such Images.

You represent that you have valid rights and title in any and all Content/Images that you submit on the Website and the Service, that you have not infringed on any intellectual property rights belonging to any party and further that you will indemnify Docthub and its affiliates for all claims arising out of any Content and Images that you post on the Website and the Service.

Posting/ uploading of any information or material, which is harmful, defamatory, obscene, pornographic, libelous, invasive of another's privacy, profane, hateful, or racially, ethnically objectionable, disparaging, or otherwise unlawful in any manner is prohibited and any person found to be involved in such activity on this website will solely be liable for actions under the applicable laws.

If you are a publisher of news and current affairs content, then in addition to compliance with other terms mentioned herein, you shall also furnish details of your user accounts on our services to the Ministry of Information and Broadcasting as required under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 of India (“Rules”) and you shall comply with all applicable laws including said Rules. Docthub may, at its discretion, provide such publishers who have provided information under said Rules to the Ministry of Information and Broadcasting, a demonstrable and visible mark of verification as being publishers, which may be visible to all users of the service.

Docthub accepts no responsibility for the said Content/ Images. However, you understand that all Content/ Images posted by you becomes the property of Docthub and you agree to grant/assign to Docthub and its affiliates, a non-exclusive, royalty free, perpetual, irrevocable and sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such Content/ Images (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed throughout the world.

You represent that you are a responsible adult (18 years or above) and you shall be solely responsible for all Content that you upload post or otherwise transmit.

Docthub endeavours to provide a web platform for various community interactions for persons or professionals to interact and exchange views with each other. The content posted on such services is posted by the general public therefore the accuracy, integrity or quality of such content cannot be guaranteed. You understand that by using such Services on the Website and Docthub Platform, you may be exposed to objectionable matter.

By using the facility of chat and other community services, you agree not to upload, post, or otherwise transmit any matter or views, which are, defamatory, abusive, pervasive, obscene, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable. You may also not indulge in cyber stalking, become or create a nuisance for any visitor/ User of the Website and the Service.

You may not send, submit, post, or otherwise transmit, material or messages that contain software viruses, malware, or any other files that are designed to interrupt, destroy, and negatively affect in any manner whatsoever, any electronic equipment in connection with the use of the Website and the Service, or another User's ability to engage in real time exchanges.

You shall not host, display, upload, modify, publish, transmit, store, update or share any information on the Website and the Service, that

Any Content uploaded by you shall be subject to relevant laws and may disabled, or and may be subject to investigation under appropriate laws. Furthermore, if you are found to be in non- compliance with the laws and regulations, these Terms, or the privacy policy of the Website, we may terminate your account/ block your access to the Website or the Service and we reserve the right to remove any non-compliant Content uploaded by you. Additionally, unlawful content will be removed on being notified by a government agency or by an order of any court or as required under applicable laws.

Furthermore, if you are found to be in non-compliance with the laws and regulations, these terms, or the privacy policy of the Website, the Company shall have the right to immediately terminate/ block your access and usage of the Website and the Company shall have the right to immediately remove any non-compliant Content and or comment, uploaded by you subject to retaining such information as required under applicable laws and shall further have the right to take recourse to such remedies as would be available to the Company under the applicable laws.
